1. Acceptance of Terms
These Terms and Conditions ("Terms") govern your use of Kind Caller and the services provided through our website, including any associated content, subscriptions, and resources. By using the website and/or subscribing to our service, you agree to comply with these Terms. If these Terms don’t feel right for you, we understand, please refrain from using the service until you’re comfortable continuing.
2. About the Service
Kind Caller offers educational in-app and online self-kindness journeys and experiences. Our services are not a substitute for professional medical, psychological, or emergency care.
3. Free Trial
When you sign up to the app for the free trial, you’re granted a free trial which is part of the First Insights journey. During this time, you can explore the features of Living Gently at no charge. After the trial ends, you’ll have the option to subscribe to the full 12 week journey.
While using the trial, you agree not to:
Not modify or copy any materials from our site for commercial purposes.
Transfer or redistribute any materials.
At the end of the trial, you can choose to subscribe.
4. Subscription & Payments
If you decide to continue, you will be prompted to subscribe. Here's how it works:
Subscription: All subscriptions are billed on a monthly basis, in advance, and start the day you subscribe. You will receive an invoice for your monthly subscription.
Payment: We use Stripe for secure payment processing. Your credit card details are encrypted for security. Payments are processed at the beginning of each monthly billing cycle.
No Refunds: Because we offer a free trial to help you decide if Living Gently feels right for you, we generally don’t offer refunds after subscribing. However, if you experience any technical or access issues, please contact us, we’ll always do our best to help.
Add-ons: You may choose to add extra features or services for an additional cost. Any additional purchases will be clearly outlined before you confirm.
5. Managing Your Subscription
You have full control over your subscription:
Cancel Anytime: You can cancel your subscription at any time. If you cancel before the end of your current billing cycle, your access will continue until the end of that period, but you won’t be billed again.
Pause: You can pause your plan if needed. Contact us if you want to make any changes to your current subscription.
6. Account Security
You are responsible for maintaining the confidentiality of your account and password. If you notice any suspicious activity or unauthorised access, please notify us immediately. We will take all necessary steps to protect your data.
7. Communications
By subscribing to Kind Caller: Living Gently, you consent to receiving important communications regarding your account, your subscription, and any updates to the service. You can opt out of receiving marketing emails at any time by unsubscribing from the email.
8. User Responsibilities
We ask that all users respect the service and others using it. You agree not to:
Use the service for any unlawful or harmful purpose.
Attempt to reverse-engineer or tamper with the software or materials provided.
Share your account or allow others to use it without proper authorisation.
If we believe the service is being used in a way that could cause harm or goes against these terms, we may need to pause or end access. We’ll always aim to communicate clearly and fairly if that ever happens.
9. Privacy & Data Protection
Your privacy is important to us. Any personal data we collect will be handled in accordance with our Privacy Policy, which outlines how we store, process, and protect your information. By using the Living Gently app, you consent to the practices described in the Privacy Policy.
We will never share your personal details without your consent, except as required by law.
10. Liability
While we strive to provide a smooth and supportive experience, there may occasionally be things beyond our control. We can’t take responsibility for issues outside our service, but please let us know if something isn’t working, we’ll do our best to make it right. Our service is designed to support your experience, but it is not a replacement for professional healthcare. In case of any issue, please contact us, and we will do our best to resolve the matter.

These Terms are governed by the laws of New Zealand. Any disputes will be handled by the non-exclusive jurisdiction of New Zealand’s courts.

All content provided through Kind Caller, including but not limited to text, graphics, logos, audio, video, programme materials, and digital communications, is the intellectual property of Kind Caller or its content providers, and is protected by copyright and intellectual property laws in New Zealand and internationally. By accessing our content, you are granted a limited, revocable, non-transferable licence to use it for personal, non-commercial purposes only. You may not reproduce, distribute, modify, create derivative works from, publicly display, or otherwise exploit any content without our express written permission. Use of our materials must not infringe upon our rights or those of any third party.

We’re happy for you to share quotes or reflections from your experience, as long as they remain personal and aren’t used for commercial purposes.
15. General Provisions
Transfer of Rights: You may not assign or transfer your rights to another person.
Force Majeure: We are not liable for any delays or failures in performance resulting from events beyond our control (e.g., natural disasters, technical issues).
Severability: If any part of these Terms is found to be invalid, the rest will remain in effect.
Entire Agreement: These Terms represent the entire agreement between you and Kind Caller.
