Welcome to Kind Caller. By using Kind Caller or purchasing our services at kindcaller.nz or through the Living Gently™ app, you agree to these Terms & Conditions. Please read them carefully.

1. About the Service

Kind Caller offers structured educational wellbeing practices, programmes, resources and community experiences for caring for attention in everyday moments. These include Compassionate Strength™ Practice and the Living Gently™ Club. The Living Gently™ app provides access to selected practices and resources, including the free Kind Morning Pause practice.

Important: Kind Caller is not a mental health or healthcare service. Our services are not therapy, counselling, or medical care, and do not provide diagnosis or crisis support. They are not a substitute for professional care when that is needed.

2. Free Practice

  • You may sign up for a free practice to explore the Kind Caller app experience.

3. Guided Practice Sessions

  • Guided Practice Sessions are pay-as-you-go.

  • Payment is made when you book a session.

  • Each session is charged at the advertised price at the time of booking.

  • Any cancellation or refund conditions for a session will be provided at the time of booking.

4. Memberships

  • Kind Caller offers Practice Memberships and Living Gently™ Club Memberships.

  • Membership prices and payment arrangements are shown when you join. Memberships are billed monthly in advance, and payments are processed via Stripe.

  • You may cancel your membership at any time. If you cancel, your membership and access will continue until the end of your current paid period, and you will not be charged for the following month.

  • We generally do not offer refunds for change of mind after a membership payment has been made. This does not affect your rights under the Consumer Guarantees Act 1993 or any other rights you may have under New Zealand law.

5. Account & Security

  • You are responsible for your account and password security.

  • Notify us of any unauthorized access immediately.

  • Do not share your account without permission.

6. User Responsibilities

  • Please use Kind Caller and the Living Gently™ app respectfully and responsibly:

    • Do not use the service unlawfully or in a way that may harm others.

    • Do not attempt to interfere with or misuse the service.

    • Respect other people using the service.

  • If these Terms are seriously or repeatedly breached, we may need to suspend or end access to Kind Caller or the Living Gently™ app. Where reasonably possible, we will let you know first.

7. Communications & Marketing

  • By subscribing, you consent to receive account and service updates.

  • You may opt out of marketing emails at any time.

8. External Links & References

  • Our website may contain links to external resources. These are provided in good faith. We are not responsible for the content, accuracy, or privacy practices of third-party sites. Please use your own judgment when engaging with them.

9. Intellectual Property

  • All content on KindCaller.nz and Living Gently app, including text, visuals, images, videos and programme materials, is owned by Kind Caller or licensed from third parties.

  • You may use our content for your own personal, non-commercial use. You may not reproduce, distribute, modify, sell or commercially use our content without our permission.

  • Trademarks: Kind Caller®, Kind, Kinder, Kindest™ and Living Gently™ are trademarks of Kind Caller.

10. Privacy & Data Protection

  • We handle your personal information in accordance with our Privacy Policy, which explains what information we collect, how we use it, and the circumstances in which it may be shared.

11. Liability

  • While we aim to provide a smooth and supportive experience, we cannot take responsibility for issues outside our reasonable control.

  • Nothing in these Terms limits or excludes any rights or remedies you have under the Consumer Guarantees Act 1993 or any other rights that cannot lawfully be excluded or limited.
